60-year-old sentenced to 12 yrs’ RI for raping teen

New Delhi: Sentencing a 60-year-old man to 12 years’ rigorous imprisonment for sexually assaulting a 14-year-old girl and impregnating her, a Delhi court has outlined that children are falling victim to sexual offences committed by their family members, relatives, neighbours, teachers and acquaintances.
Being innocent due to their age, both boys and girls are being abused, the court of additional sessions judge Susheel Bala Dagar noted.

“In a patriarchal society like ours, everyone is quick to blame the child in any such incident of penetrative sexual assault… Rather, it is the convict on whom full blame ought to lie as he, despite being a neighbour, is responsible for the heinous crime against the child,” the court said on Thursday, imposing a fine of Rs 5 lakh, which will be given to the survivor.
The case was registered on May 11, 2018 and the man was convicted for offences under the Pocso Act in Dec 2024.
Additional public prosecutor (APP) Yogita Kaushik Dahiya submitted before the court that the child gave birth to a baby, whom she put in a polypack and left on the street. The newborn was found by a passerby.
The APP said even though the survivor was “won over” by the man at the time of her deposition, the medical evidence, FSL result and the entire prosecution version show the convict influenced her as he was already helping her family financially.
Dahiya said even though the survivor’s baby was born by way of IVF, there was no denying that she suffered pain, incurred expenditure on her treatment, and faced hardships, disappointment and inconvenience, including anxiety, depression and emotional harm, for which she needed to be compensated.
Stating that violence against children can have profound long-term effects, the court observed: “The assault of a girl child of an immature age has a greater traumatic effect, which often persists throughout her life, leading to various disorders, both physical and psychological. The effects of penetrative sexual assault are multidimensional. She has to face the questioning looks of society, including her own family, relatives, friends and neighbours…”
It said such cases can result in mental torture and suffering for the survivor. “The younger she is, the greater the repercussions. It is no doubt true that deterrence does not come from a mechanical increase in punitive severity but from quick investigation, prompt prosecution and urgent finality. But this does not mean that undue leniency should be shown to the convicts, thereby reducing the confidence of the victims in the criminal justice administration,” said the court.
